Are you facing your first business lawsuit?

On Behalf of | Mar 18, 2020 | Firm News

As a small business owner, you have likely had many ups and downs. You may have experienced numerous challenges just getting your business up and running, and it may always seem like there is another difficulty around the corner. However, you feel confident in your abilities and work hard to ensure that everything runs as smoothly as possible.

Of course, a significant portion of businesses face some type of legal claim or lawsuit during the course of their business operations. You may have recently found yourself facing this type of predicament for the first time, and understandably, you may worry what it could mean for your company. Luckily, you have options.

Have the right information

First, you may want to determine what type of situation you and your company are facing. Someone could file a claim against your company due to an error or defect with a product or service provided by your company. For example, someone could claim that he or she suffered an injury while using your product and file a claim. Typically, a claim involves insurance companies, and a person may want compensation for the injuries and other damages.

A lawsuit goes beyond simply involving insurance companies, especially if a person or another entity has an issue that goes beyond just monetary damages, such as another company suing your company for a copyright violation, for example. It is important to remember, though, that a claim could turn into a lawsuit if one or both parties are not satisfied with the handling of the claim.

Prepare a defense

Hopefully, you purchased liability insurance as one of the first steps of starting your company. Of course, your protection does not stop there. You may feel that the claim or lawsuit does not merit compensation from your company or that your company has not done anything wrong, and as a result, you want to defend against the allegations. Fortunately, you can do just that.

Business litigation can be long and difficult, and if you are facing your first lawsuit, you may feel overwhelmed. Luckily, you can work with an attorney experienced in this type of litigation and determine how to best handle the ordeal. You can obtain information specific to your case and advice on how to approach your case in a manner with which you feel most comfortable.
